1. Overview and Acceptance of Terms

Welcome to Nu Kreature Music.

These Terms of Sale ("Terms") govern purchases, downloads, merchandise orders, and voluntary financial support ("Gifts") made through NuKreatureMusic.com (the "Website").

Throughout these Terms, "Nu Kreature Music," "we," "our," and "us" refer to the business operating the Website. "You" and "your" refer to customers, purchasers, and individuals providing financial support.

By placing an order or completing a transaction through the Website, you acknowledge that you have reviewed and agree to these Terms and our applicable policies.

You must be at least 18 years old or have the authorization of a parent or legal guardian to make a purchase.

Nothing in these Terms limits consumer rights that cannot legally be waived under applicable federal, state, or international law.

2. Prices, Payments, and Taxes

Pricing

All prices are displayed in United States dollars (USD), unless otherwise indicated.

The total amount payable, including applicable sales taxes, VAT, shipping charges, and other required transaction charges, will be disclosed before completing payment.

Certain music releases may offer a "Name Your Price" option, allowing customers to choose their purchase amount, subject to any displayed minimum and a maximum of $500 USD per item.

Any amount voluntarily paid above a suggested price does not establish ownership of the music, additional licensing rights, or eligibility for charitable tax deductions.

Payment Processing

Payments are processed through Stripe, our third-party payment processor.

By submitting payment information, you authorize the applicable charge to your selected payment method.

Nu Kreature Music does not independently guarantee the availability of any particular payment method. Transactions may be subject to Stripe's applicable payment terms and security procedures.

All purchases are one-time transactions unless a recurring payment arrangement is separately and clearly disclosed and expressly authorized.

Order Confirmation

Following a successful transaction, customers will receive an electronic confirmation using the email address provided at checkout.

We reserve the right to decline or cancel an order where reasonably necessary because of suspected fraud, unlawful activity, product unavailability, or a material pricing or technical error.

If we cancel an order after collecting payment, we will refund the amount charged for the canceled items.

3. Digital Music Purchases and Delivery

Digital Delivery

Digital music purchases are delivered electronically.

After successful payment, customers receive an email containing download instructions or links for purchased music.

Depending on the release, downloads may be available in MP3, WAV, or other formats specifically identified on the applicable product page.

Download Availability

Unless otherwise stated at checkout:

Download links remain active for 30 days after issuance.

Each purchased file may be downloaded up to five times.

Access may expire when the applicable time period or download limit is reached, whichever occurs first.

Customers are responsible for saving and backing up downloaded files.

We do not guarantee indefinite hosting or permanent access to previously purchased files.

If a download link expires, becomes inaccessible, or fails, customers may request assistance through our download recovery page at https://www.nukreaturemusic.com/downloads or contact support@NuKreatureMusic.com.

We may verify the original purchase before restoring access. Requests for additional access are subject to technical availability and applicable consumer protection laws.

Digital Product Problems

If a purchased file is missing, corrupted, materially different from its description, or otherwise defective, contact us so we can investigate.

Where appropriate, we will provide a functioning replacement, restore access, or provide another remedy required by applicable law.

4. Digital Music Refunds and Cancellation Rights

General Refund Policy

Because digital music is delivered electronically and can be retained after downloading, completed digital purchases are generally final sale once delivery has begun.

We do not ordinarily provide refunds for accidental purchases, changes of mind, or dissatisfaction with artistic preferences after digital delivery begins.

This policy does not apply where a refund, replacement, cancellation, or other remedy is required by applicable law, including for defective, misrepresented, undelivered, or unauthorized transactions.

European Union and United Kingdom Customers

Customers located in jurisdictions that provide statutory cancellation or withdrawal rights may be entitled to a 14-day cancellation period for certain online digital purchases.

Where permitted by applicable law, customers may lose their statutory cancellation or withdrawal right when the supply of digital content begins, provided that all applicable legal requirements have been satisfied.

Before immediate digital delivery begins, we will request the customer's express consent to begin supplying the digital content during the applicable cancellation period and acknowledgment that the statutory cancellation or withdrawal right will be lost once supply begins.

Where required, this consent and acknowledgment will be obtained through a separate, affirmative checkout action and confirmed in an email or other durable record.

If the legally required consent, acknowledgment, or confirmation is not obtained, the customer's statutory cancellation rights remain applicable. We may defer digital delivery or decline to complete an immediate-delivery transaction.

Preservation of Consumer Rights

No final-sale provision excludes rights relating to faulty digital content, failure to supply purchased content, or other non-waivable statutory protections.

5. Digital Music Licensing and Intellectual Property

All music, recordings, artwork, lyrics, compositions, and associated content offered through Nu Kreature Music are protected by applicable copyright, trademark, and intellectual property laws.

Purchasing music provides a limited, non-exclusive, non-transferable license for personal, noncommercial use unless a separate written license expressly provides otherwise.

Purchasing or downloading content does not transfer copyright ownership or other intellectual property rights.

Without prior written permission from the applicable rights holder, customers may not:

Redistribute, resell, sublicense, or publicly upload purchased files.

Share download links or distribute copies to third parties.

Use music in advertisements, films, commercial productions, or other projects requiring synchronization or commercial licensing rights.

Claim ownership or authorship of purchased recordings.

Use the recordings to create unauthorized commercial derivative works, remixes, or samples.

These restrictions do not prohibit uses permitted by applicable copyright law, including applicable statutory exceptions and limitations.

6. Free Music Downloads and Email Communications

Certain music releases may be made available at no charge.

Customers may be required to provide a valid email address to receive download links, transaction confirmations, or delivery assistance.

Where we offer email newsletters, music announcements, merchandise promotions, or other marketing communications, subscription consent will be requested separately where required by law.

Customers may decline optional marketing communications without losing access to an otherwise available free download.

Marketing emails will identify the sender and provide an appropriate unsubscribe mechanism.

Customers may withdraw marketing consent or unsubscribe at any time without affecting existing purchases or their rights to previously obtained downloads.

Personal information is handled in accordance with our Website's Privacy Policy and applicable data protection laws.

7. Merchandise Orders and Fulfillment

Print-on-Demand Production

Nu Kreature Music merchandise is produced and fulfilled through Printful, our third-party print-on-demand fulfillment provider.

Merchandise is generally made after an order is placed rather than maintained as preprinted inventory.

Currently, merchandise orders are available for shipping to addresses within the United States only.

Shipping

Applicable shipping charges will be presented before checkout is completed.

Estimated production, shipment, and delivery timeframes may vary based on the product, destination, carrier, and fulfillment conditions.

Delivery estimates are not guarantees unless expressly identified as guaranteed.

We will have a reasonable basis for any advertised shipment timeframe. If no shipment period is specified, we will comply with the applicable default shipment requirements established by federal law.

If we cannot ship within the promised or legally applicable timeframe, we will provide legally required notice and an opportunity to consent to a delay or cancel the unshipped merchandise order for a prompt refund.

Merchandise Returns and Replacements

Because merchandise is produced on demand, returns or exchanges for changes of mind, incorrect size selections, or personal preferences generally are not accepted except as provided in our Refunds and Returns Policy or required by applicable law.

Damaged, defective, misprinted, or incorrect merchandise may qualify for replacement or another appropriate remedy.

Customers should report product problems and provide photographs through our returns process as described in our Refunds and Returns Policy.

Nothing in this section limits statutory rights or remedies for defective, misrepresented, or undelivered merchandise.

8. Voluntary Gifts and Ministry Support

Nu Kreature Music may accept voluntary financial support to help fund music production, creative projects, outreach, and related ministry activities.

These payments are referred to as "Gifts" throughout the Website.

Important Tax Disclosure

Nu Kreature Music is not represented as a tax-exempt charitable organization under Section 501(c)(3) of the Internal Revenue Code.

Accordingly, Gifts made directly to Nu Kreature Music are not tax-deductible charitable contributions for federal income tax purposes.

Gifts are voluntary support payments. Unless expressly stated otherwise, providing a Gift does not entitle the contributor to merchandise, digital content, membership benefits, ownership rights, or any other goods or services.

Gifts are generally final and non-refundable once successfully processed, except where a refund is required by law or approved by Nu Kreature Music.

We reserve the right to refund Gifts in cases involving duplicate payments, processing errors, unauthorized transactions, or other circumstances we determine appropriate.

We make no representation that a Gift creates a charitable trust or any other legally restricted charitable contribution arrangement.

9. Monthly gifts

A monthly gift repeats on the same day each month until it is canceled.
You can cancel anytime. Use the "Manage or cancel" link in any email we send about your gift, or write to nukreaturemusic@gmail.com.
When a gift is canceled, no more charges are made. Gifts already given are final and are not refunded.
Monthly gifts are not tax-deductible, because Nu Kreature Music is not a registered nonprofit.

10. Refunds, Payment Disputes, and Chargebacks

Refund requests for merchandise and other eligible transactions are governed by our Refunds and Returns Policy, together with these Terms and applicable law.

Customers are encouraged to contact support@NuKreatureMusic.com if they believe a charge is incorrect or a product was not delivered as promised.

We will review payment concerns in good faith.

Nothing in these Terms restricts a customer's lawful right to dispute a charge through a bank, credit card issuer, payment processor, or consumer protection authority.

If a purchase is refunded, reversed, or canceled, we may revoke future download access and terminate the corresponding license to the refunded content, to the extent permitted by law.

During a legitimate investigation of suspected unauthorized payments or fraud, we may temporarily restrict access associated with the disputed transaction where reasonable and legally permissible.

We will not use access restrictions to penalize customers for exercising legally protected consumer rights.

11. Website Availability and Third-Party Services

We make reasonable efforts to maintain access to the Website, purchased digital content, and customer support resources.

However, Website functionality and digital delivery may occasionally be affected by maintenance, technical failures, hosting interruptions, network outages, or third-party service disruptions.

We do not guarantee that the Website will operate continuously or without interruption.

Our services may depend on third parties, including Stripe, Printful, hosting providers, email delivery services, and shipping carriers.

We remain responsible for our own legal obligations to customers, including legally required delivery, refunds, and consumer remedies, even when third-party services are involved.

12. Warranties and Disclaimers

Products and services are provided according to the descriptions, specifications, and representations made at the time of purchase.

To the fullest extent permitted by applicable law, and except for warranties expressly provided or that cannot lawfully be excluded, we disclaim implied warranties not otherwise required by law.

We do not warrant that every digital file will operate on every device or software application, or that the Website will be entirely free from interruptions or technical issues.

Customers are responsible for ensuring their devices can support the disclosed file formats and technical requirements.

These disclaimers do not limit statutory warranties, guarantees, product conformity rights, or consumer remedies that cannot legally be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Nu Kreature Music and its owners, personnel, and authorized representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from purchases or use of the Website where such liability may lawfully be excluded.

For claims arising out of a particular transaction, our aggregate contractual liability will not exceed the greater of:

The amount paid to Nu Kreature Music for the transaction giving rise to the claim; or $100 USD.

This limitation applies only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where liability cannot be restricted, death or personal injury where exclusion is prohibited, or any other liability or consumer remedy that cannot legally be excluded or limited.

Nothing in this section waives rights under the Texas Deceptive Trade Practices–Consumer Protection Act or any other applicable mandatory consumer protection law.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflicts-of-law principles, except where applicable mandatory law requires otherwise.

For disputes that may legally be subject to a contractual forum selection provision, the parties agree to the jurisdiction of the appropriate state courts located in Collin County, Texas, or the federal courts having jurisdiction over that county.

This provision does not override mandatory consumer protections or any non-waivable right to bring a claim in a consumer's home jurisdiction.

Before initiating formal proceedings, customers are encouraged, but not required, to contact us at support@NuKreatureMusic.com so we have an opportunity to review and attempt to resolve the matter.

Nothing in these Terms prevents customers from filing complaints with appropriate government agencies, exercising lawful payment dispute rights, or pursuing other remedies available under applicable law.

15. International Purchases

Digital products may be made available to customers outside the United States, subject to applicable laws, payment availability, and any geographical restrictions disclosed at checkout.

Physical merchandise currently ships only within the United States.

International customers remain entitled to mandatory consumer rights applicable to their purchases.

Where applicable, required taxes, digital content disclosures, cancellation rights, and consumer protections will be addressed in accordance with the laws governing the transaction.

If any provision of these Terms conflicts with a mandatory consumer protection law applicable to a particular customer, that mandatory law will control to the extent of the conflict.

16. Changes to These Terms

We may revise these Terms to reflect changes in our services, business practices, or legal obligations.

Updated Terms will be posted on the Website with a revised effective date.

Changes will apply prospectively unless applicable law permits otherwise.

The Terms in effect when a purchase is made will generally govern that transaction.

We will not retroactively remove vested contractual rights or statutory protections through an updated policy.

17. Severability and Entire Agreement

If a provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Terms, together with the applicable product descriptions, checkout disclosures, order confirmation, and referenced policies, constitute the agreement governing purchases through the Website.

If an order-specific term expressly conflicts with a general provision of these Terms, the more specific lawful provision applicable to that order will control.

Our failure to enforce a provision on one occasion does not automatically waive our right to enforce it on another occasion.
